>> they said we have a bomb threat and we got off the plane pretty darn quickly. >> a united express flight from sfo to san antonio makes an unscheduled stop in phoenix after someone on the plane made a threat. from across the bay to around the world, the stories that matter on "kpix 5 news this morning." captions by: caption colorado comments@captioncolorado.com >> your realtime captioner is mrs. linda m. macdonald. good morning, it's friday, november 1. i'm frank mallicoat. >> i'm michelle griego. time now 6:00. we begin with breaking news in milpitas. a construction worker was killed and another hurt on northbound 680 after a car struck them. these are live pictures of a dui crime scene and the backup is causing major delays. elizabeth wenger has the latest "kcbs traffic" alert. >> reporter: as you mentioned it's approaching that scott creek road exit jammed from jacklin road and they have been alternating between one and two lanes closed right now just one

lane is blocked. so the delays are not growing at this point. right now they are holding steady by the jacklin road exit. 20 miles per hour. we don't know when the investigation will be finished. it looks like now it's going into the 6:00 hour. more problems, now for sierra travelers. all lanes blocked detouring cars around the accident scene. eastbound 80 this is by truckee, but we are hearing things are pretty much jammed from 89. also, in the south bay just the usual delays 101 from san jose. there is an accident northbound 101 at tully but for the most part mostly green sensors up and down the guadalupe parkway and 280 and at the bay bridge no metering lights. let's go to milpitas for the latest on the problems there and a traffic alert. here's cate caugiran. >> reporter: as michelle

mentioned, chp did say this accident is now a crime scene and an active dui investigation. lock over here. there's still a lot of activity going on as cars are slow. scott creek road and northbound 680, two contract workers were moving a road sign for some emergency roadwork on the off- ramp and their truck was parked on the right-hand shoulder. one worker was in the back of the truck and hit by the nissan and killed in the accident. that other worker on the other side of the truck when it happened suffered minor injuries and was taken to san jose regional medical center. >> alcohol was a factor and it's an active crime scene and we'll continue to investigate. >> reporter: the driver of the nissan suffered major injuries and had to be extricated from

the car. chp tells me he is now in serious condition also at san jose regional medical center. now, once he wakes up he will have a lot of questions to answer for investigators right now. they are here on scene collecting evidence and assessing this area. no word on when the two lanes will re-open. it could be quite some time. live in milpitas, cate caugiran, kpix 5. we're following developing news in hayward, as well. a woman rushed to the hospital with life-threatening injuries after she was shot outside an apartment complex overnight. the shooting happened about 11:00 last night at a complex on sleepy hollow avenue near west tennyson road. she was taken to the hospital and is still in surgery at this hour. right now there are no witnesses or suspects. 6:03. let's check the weather. the weekend is here. >> yes. and we have some changes for the weekend. i think today going to be a spectacular day, one of the nicest days of the week as high pressure sits overhead. outside now skies are mostly clear although we are beginning to see a hint of patchy fog

toward the coastline. 50s and 40s for most although upper 30s in some of the north bay valleys. as we look toward the afternoon, these temperatures going to be warming up, above the average, 60s and 70s normally for this time of year but today, going above that about 77 degrees in livermore. 76 degrees in san jose. and about 71 just gorgeous weather into san francisco. but a cold front likely to come to town for the weekend. we'll tell you what that means coming up in just a few minutes. >> thank you. happening today, kpix 5's anne makovec is in san francisco with the big cuts hitting the food stamp program today. anne, just how much will these cuts cost millions of families on welfare? >> reporter: it depends how many people are in your family but for a family of four it could be up to $432 a year. it doesn't sound like a lot. when you depend on food stamps to feed your family each week, it is a big deal. we're talking about billions of dollars in cuts from the federal

program leaving a lot of people scraping by. >> it's hard. >> reporter: that's the situation for about 47 million americans who will see a more than 5% cut to their food stamps each month starting today. >> there's never a good time for cuts like this. but these are happening on november 1 right at the beginning of the holiday season where a lot of families struggle even more. >> reporter: congress included additional funding for the program in the 2009 stimulus bill but that expired which means a $5 billion cut in food stamp benefits nationwide. a family of three like lisa's will lose up to $29 a month. for others the loss could range from $11 to $36 for a family of four. >> if i go grocery shopping that's $23 in cash that i can have i might want to pay it on a bill or something. >> that just mean food banks are going to have to ramp up but we can't carry this load ourselves. >> reporter: and things could be getting worse very soon. congress is debating additional

cuts to the program. in fact the house just cut $4 billion from the program every year for the next 10 years. the senate is bouncing around a similar bill so it looks like either way the program will see cuts in the future. live in san francisco, anne makovec, kpix 5. >> these cuts will affect about 47 million americans. new details this morning about the threat that forced the flight from sfo to san antonio to make an emergency landing. passengers were taken off the united express flight after it landed in phoenix. officials say a threatening note was found on board. there were 46 people on the plane taken a remote area of the airport. >> we felt the descent quickly. they said we have a bomb threat and we got off quickly. >> the fbi told us to be a quarter mile away. >> the bomb squad checked the plane, the passengers and bags were rescreened and the flight went on to texas. a santa rosa teenager shot

to death by a sheriff's deputy, the family is filing a lawsuit. the lawyer representing the family of andy lopez says the suit will be filed in san francisco today. lopez was killed 10 days ago as he walked in southwest santa rosa. he was carrying a plastic pellet gun that closely resembled an ak-47. the parents of a stillborn baby suing a daly city hospital now for losing the child's body. julio and rina arriaza say seton medical center lost the remains back in october of last year. worker at a santa cruz laundry facility found the baby's body on a conveyor belt heading towards an industrial size the washing machine. >> we can't comment beyond acknowledging the fact that this is pending litigation. but our hearts certainly go out to this family and everyone here is praying for their comfort and consolation. >> the laundry facility washes linens for the hospital. it's not clear at this point

how much money the couple's attorney is seeking from the hospital. today is the day bart workers decide whether to accept new contracts. members of two unions are voting on the contracts that were worked out last month ending the strike. the proposals include 15% raises over four years. the seiu and atu local unions plan to count the ballots as soon as the polls close tonight. they expect to have results after 11 p.m. there are new rules for people working on railroad tracks in california. the state puc now says there has to be someone whose only job is to be a lookout for other track workers. also, there has to be three-way communication involving the workers, train operators and a transit agency central control. the changes follow last month's accident in which two workers were killed by a bart train. starting today, red light cameras will catch drivers making illegal turns at san francisco's busy marketed and octavia -- market and octavia intersection, the scene of many

accidents. drivers often make illegal turns on the central freeway. getting caught could result in a $238 fine. tomorrow is the first saturday in november which marks the first day of dungeness crab season. this is only for people who fish recreationally. the commercial crabbing season starts on november 15. it is a mystery no more. we have uncovered what google is up to off san francisco's treasure island. and a kpix 5 exclusive our ken bastida has confirmed the barge is a private showroom floating on the bay. reporter: a source familiar with the highly secretive project confirms it's been ongoing for more than a year spawned in the so-called google x division of the company, cloaked in secrecy even from most employees, but personally directed by google's cofounder sergey brin. a movable high-tech showroom for google projects and products reserved for only the most high level vips and tech geeks, essentially a four-story portable building constructed of interchangeable 40-foot

shipping containers that can be assembled and disassembled at will. it's designed to be placed on everything from barges to railcars and reassembled anywhere in the world. it could be at a ski resort one morning and on the beach at malibu days later. sources tell us it's google's multi-million dollar response to apple's highly successful apple store concept but with an invitation-only requirement. there is only one problem: the company was informed by the u.s. coast guard last summer that the structure, which is meant to contain three floors of dazzling showrooms and an upper party deck complete with lanais and bars, that it is in essence a floating vessel and subject to all applicable federal maritime regulations. construction appears stalled at present while google struggles to work within the coast guard's strict safety requirements. in the meantime, it sits moored in san francisco bay amid tight

worse now. that we're really getting into the thick. morning commute. -- the thicof the morning commute. the driver hit two workers, one was killed. it's jamming up towards calaveras so a couple of exits beyond scott creek road where the accident happened. a few are red sensors. it's really a bottleneck approaching the scene. so you may want to consider using 880. it's a great option for now. everything is flowing smoothly through milpitas and fremont. more problems, this is for sierra travelers all lanes blocked eastbound 80 near truckee. very stop and go right now from at least highway 89. it was a big rig accident. drivers are getting by using the shoulder and a quick look at the bay bridge toll plaza, where they just switched on the metering lights a couple of minutes ago. only backed up towards the at the end of the parking lot. that's your latest "kcbs traffic." for more on your forecast, here's lawrence. >> all right. going to see some great weather around the bay area today. lots of sunshine coming our way and mostly clear start this morning although we have seen a hit of a couple of patches of

fog toward the coastline. out the door chilly in spots this morning, 30s in the north bay valleys. otherwise sunshine this afternoon and probably the warmest day of the week. but big changes coming our way this weekend as a cold front swings into town. high pressure building across the bay area for today but toward tomorrow, we have the system developing in the gulf of alaska, that cold front not going to bring us rainfall but will bring clouds, cooler temperatures and the winds will be kicking up by tomorrow afternoon. so a much cooler weekend in store for the bay area. around the state today friday looking good though 75 degrees in sacramento and sunny. 77 in fresno and 67 degrees into monterey bay. i think around our bay today we'll see those temperatures very nice in the south bay, 78 degrees in morgan hill. 76 in san jose. and 75 degrees in los altos. east bay numbers in the mid- to upper 70s with plenty of sunshine all afternoon. and beautiful inside the bay. how about 71 even into san

bad to worse. let's get out to kpix 5 reporter cate caugiran. she has the latest on the investigation live from milpitas. good morning, cate. >> reporter: liz, i just got some new information from chp moments ago. they say that the two victims in this crash worked for statewide traffic safety and signs out of fairfield. meanwhile, the commute is kind of getting backed up right here. we are going to give you a look right now. it could be quite some time before the roads open up around northbound 680. you see the backup there. now we are learning this is an active dui investigation! let's take a look at some video we have from earlier. here's what happened. two contract workers were moving a roadway sign just south of some emergency roadwork along the off-ramp. their truck was parked along the right-hand shoulder and that's when a silver nissan hit the back of the work truck. one worker was standing there at the time of the crash and was killed. the other was on the other side of the truck and suffered minor injuries.

>> this is an active dui investigation. it is -- we have confirmed that alcohol was a factor in the collision. so we are going to be processing the crime scene. our multidisciplinary accident investigation team is responding to the scene. the standard for allstate jobs, these sign movers were employed by caltrans. so it's standard procedure for us to bring them down. >> reporter: chp says the driver of the nissan had to be extricated from the car and was taken to san jose regional medical center with life- threatening injuries. but now he is in stable condition. we are learning that there are no witnesses to this accident. and at this point, we know that no one who was involved has been identified. reporting live in milpitas, cate caugiran, kpix 5. >> good morning, everyone. it is a busy morning. friday, november 1. i'm frank mallicoat. >> i'm michelle griego. time now is 6:32. happening today, one in 7

americans will have less money for food. anne makovec joins us from san francisco with impacts to the cuts to the fad stamp program. >> reporter: we know how challenging it is to meet your food budget every month at grocery stores like this. with these cuts that go into effect today for a family of four, this means that they get $432 fewer a year to spend on food. reporter: single mother lisa otis says she may run out of money next month trying to feed her two children. after losing her job she began receiving $450 a month from the nation's food stamp program but she and another $47 million americans will soon see more than 5% cuts. >> i have to tell my 13-year- old, sorry hold off on that peanut butter and jelly sandwich we have to make that loaf of bread last, you know? you don't want to tell these kids that. >> reporter: congress included additional funding for the program in the 2009 stimulus bill but that expired which means a $5 billion cut in food stamp benefits nationwide. a family of three like lisa's will lose up to $29 a month. for others the loss could range

from $11 to $36 for a family of four. valencia adams who oversees a nonprofit for low-income families in southern california worries the demand for food banks will spike. >> you're talking about families maybe having to decide about, you know, whether we pay the light bill, whether we pay all of the rent and could end up facing homelessness. >> reporter: lisa hopes a social worker can help her family find housing. they are temporarily living in a hotel. >> if you are struggling now, what will it be like with these cuts? >> more struggles. you got to wake up every day and face it. >> reporter: and there could be more cuts coming. congress is debating that right now. in fact, the republican- controlled house is considering an additional cut of $4 billion from that program. live in san francisco, anne makovec, kpix 5. >> that program costs $80 billion a year, more than doubled over the last five years.

these cuts will affect 47 million people. a 29-year-old man is accused of leaving his children locked in an suv for more than 14 hours. julio reyes of san jose was arrestedded wednesday night. milpitas police say a woman called 911 that afternoon saying a ford explorer had been parked all night near her home and people were in it. officers found a 10-year-old girl and 8-year-old boy inside. >> the children were very cold, very tired, very hungry, and the officers took them into protective custody and brought them back here to the police station. >> police say reyes admitted he went to a friend's house and left the kids and suv behind. he faces a felony child endangerment charge. 6:35 now. stanford university believes norovirus is to blame for sickening dozens of students who live on campus there. the 52 students all ate at the florence moore dining hall. they complained about flu-like symptoms including vomiting and

diarrhea on tuesday and wednesday or briefly hospitalized for dehydration. there have been no new cases reported since then. workers have been busy sanitizing the dining hall common areas and bathrooms in that complex. a janitor who stayed behind to help patients abandoned at a castro valley assisted care facility is speaking out about the facilities. he said he and a coworker were scrambling to help patients. state officials closed the facility last week. patients who were left behind are now staying somewhere else. the fbi and other law enforcement agencies are investigating if any charges will be filed. happening today, the mavericks surf window opens up near half moon bay. that means that the conditions are just right surfers from all around the world will have 24 hours' notice to get there for the surfing competition but there have been years in the past when waves never got big enough so the contest never took place, i believe last year was one of those years. the nightly show on the bay bridge will now happen whenever it is dark. the nonprofit group that's been

funding the l.e.d. light sculpture is backing a continuous display from dusk to dawn. up until now, the shutoff time has been 2 a.m. artist leo villareal has programmed new sequences for the all night shows starting tonight. silicon valley help is on the way to fix the federal government's healthcare website. michael dickerson a google engineer has been recruited to address numerous problems plaguing healthcare.gov. software companies oracle and red hat will also take part in the effort. as cbs news' susan mcginnis reports, newly obtained documents show enrollments on the national site got off to an amazingly slow start. >> reporter: the troubled healthcare.gov website hits its one-month anniversary today, but no one in the white house is celebrating. newly obtained documents from cms the agency running the site revealed major problems from the start. through the first two days, only 248 people had signed up for insurance. the notes also tell why

including high capacity on the website, direct enrollment not working. >> while the would be -- >> reporter: republicans this week grilled the head of cms to find out the current totals. she wouldn't share, even though the documents show the government has access to them. >> no numbers on who has enrolled? no idea? >> we'll have those numbers available mid-november. >> reporter: insurance companies are telling more than 3 million americans they will soon lose their current policies because they don't meet new government requirements like maternal care and emergency visits. >> in many cases, the inability of an individual to not keep his coverage is because his insurance company has decided to phase out his plan. >> reporter: the white house claims many of those people will qualify for subsidies to offset the cost of new plans. susan mcginnis, cbs news, washington. >> the obama administration has the goal to get 7 million people to sign up by march 1,2014. today is the pick of the

winner. here now is kcbs radio's financial reporter jason br. let's lead with the new ipar going on sale..and how apple needs it to be a big sellero stave off growing ion. then will hit apple as new ipad is for sale. here to chat is kcbs radio's financial reporter jason brooks. >> reporter: the new ipad air on sale in 42 countries including the united states. the base model starts at $499 for the wi-fi-only version. it is thinner and lighter than the prior ipad. also, the new processor a whole lot faster and it's getting really good reviews from a number of tech sites. it is a key launch for apple. it has dominated the tablet market since launching the first ipad in 2010 but in the 3rd quarter of this year, idc says apple shares have fallen to less than 30% of the market

while samsung has climbed up to 20% and you have a host of other companies also getting in on the action. the new ipad mini will reportedly go on sale on november 21. chevron out with its earnings report for the 3rd quarter and the san ramon based company missed on both profit and revenue forecasts. profit fell 6% to $4.9 billion. revenue up a little bit at about 56 buildings big numbers for sure. it's refining business fell 45% due to higher costs it couldn't pass along in higher gas costs. chevron shares are falling on that report. market getting off to a good start this morning after two straight losing sessions. let's look at the big board. the dow up 69 points. nasdaq is gaining 15. s&p up by 6 points. chevron down by nearly 2%. apple shares are up by .25%. michelle and frank, back to you. >> jason brooks from kcbs news, thank you. let's kick it to traffic on what's been a very busy

scene and an active investigation. take a look at this traffic asouth of scott creek road. it could be another hour before the road reopens this after the driver of a nissan hit two contract workers. the contract workers were moving a road sign along the off-ramp. the truck was parked on the right-hand shoulder. one worker was in the back of the truck and was struck immediately by the nissan and killed in the accident. the other worker was at the other side of the truck when it happened and he suffered minor injuries and was taken to san jose regional medical center. >> at this point we know alcohol was a factor in the collision. it does become an active crime scene. and we will continue to investigate it. >> reporter: the driver suffered major injuries including breaking both legs and had to be extricated from the car. chp says he is in serious condition at san jose regional
